General Terms and Conditions of LazyFriday s.r.o. for the LazyFriday catio service

1. Establishment and conditions of the contractual relationship

1. 1. These General Terms and Conditions are concluded between the Customer and the Provider on the basis of the provisions of the
subsequent regulations.

 

1. 2. The Provider of the services offered on the website LazyFriday s.r.o. - LazyFriday catio (www.catio.cz) is:

hereinafter referred to as the Provider .

1. 4. Catio nanny: A natural person in a contractual relationship with the Provider performing pet-sitting services under the LazyFriday catio brand. Hereafter referred to as the Nanny .
 

​1. 5.  Customer: customer means a natural person who orders and or uses services under the LazyFriday catio brand at LazyFriday s.r.o. Hereinafter referred to as: the Customer .

2. The provision of cat and other animal sitting services

The subject of performance is the provision of cat-sitting services at the Customer's home, resulting from the Provider's business.

2. 1. The Provider, represented by the Nanny, hereby undertakes to the Customer to provide care for the Customer's cats and other pets according to the agreed "Pet-sitting Agreement".

 

2. 2. The Provider, represented by the Nanny, hereby undertakes to care for the Customer's animals with love, professionalism, discretion and respect for the Customer's home.

 

2. 3. The Provider, represented by the Nanny, hereby undertakes to be present only on the premises strictly necessary to perform the acts specified in the "Pet-sitting Agreement".

 

2. 4. The Provider represented by the Nanny is bound by strict confidentiality of the services provided to third parties according to the Czech Republic Act No. 101/2000 Coll. on the protection of personal data and is governed by the internal regulations for the handling of personal data of customers of LazyFriday s.r.o.

 

2. 5. The Nanny work according to the standard practices of the profession and do their work to the best of their knowledge and conscience

 

2. 6. The Provider, represented by the Nanny, undertakes to inform the Customer about the current health and psychological state of the entrusted animal after each visit and after each walking in written form, photo and/or video documentation. The choice of the form of information is at the sole discretion of the Provider.

2. 7. LazyFriday catio services may not be suitable for all cats, especially intolerant, aggressive, psychologically attached to their owners or difficult to socialise cats. The provider reserves the right to refuse service to cats it deems unsuitable for the service provided. 

2. 8.  LazyFriday catio services are intended for healthy cats in good physical and mental condition who do not suffer from any serious medical conditions. The provider reserves the right to refuse service to cats it deems unsuitable for the service provided. 

2. 9. By signing the"Pet-sitting Agreement", the Customer gives the Provider, represented by the Nanny, permission to care for the cats and to perform other tasks specified in the "Pet-sitting Agreement" according to the dates and at the address specified in the "Pet-sitting Agreement".

2. 10. The Customer, the owner of the animal, by placing the order, gives the Provider consent to provide veterinary care to the animal in the event of an emergency. The Provider shall immediately inform the Customer of this circumstance. Veterinary care and costs associated with the provision of veterinary care shall be borne in full by the Customer.

2. 11.  In the event of very bad weather (hail, heavy rain, severe frost, tropical heat, etc.), the Provider reserves the right to carry out the walking service for the length of time strictly necessary to carry out the cat's needs, taking into account the cat's individual feelings, health and physical condition.

2. 12. The Customer, upon signing the "Pet-sitting Agreement", hands over the keys to the cat's residence to the Provider represented by the Nanny and agrees to the return date specified in the "Pet-sitting Agreement".

2. 13. The Provider has concluded "Insurance of entrepreneurs and legal entities" with Allianz pojišťovna, a. s. with a limit of coverage of CZK 20,000,000.

2. 14. The "Pet-sitting Agreement" for cat-sitting and cat care becomes valid upon the Customer's signature and payment the amount of the cat-sitting fee to the Provider's account.

2. 15. The "Pet-sitting Agreement" is made in two copies, one to be received by the Customer and the other by the Provider represented by the Nanny.

2. 16.  All data from the 'Pet-sitting Agreement' shall be transferred electronically to the Roza Platform and information, data and communication from the 'Pet-sitting Agreement' shall take place within the Roza Platform, unless otherwise specified by the Provider, to which the Customer expressly consents.

3. Visit at the place of care

3. 1. The length of the visit, i.e. the time that the Nanny is present at the place of pet-sitting, is governed by the purchased tariff, the name of which indicates the maximum length of one visit at the place of care and the type of visit as follows: 

3. 1. 1. Tariff with a visit of 30 minutes includes a visit to the Client including all activities in the standard length of 20 - 30 minutes according to the current needs of the cat.

3. 1. 2. Tariff with a visit of 60 minutes includes a visit to the Client including all activities in the standard length of 40 - 60 minutes according to the current needs of the cat.

3. 1. 3. The initial appointment at the pet-sitting's location, which is a mandatory part of every Order, is normally 10 - 30 minutes.

3. 1. 4. The assessment of the actual needs of the cat and the adjustment of the visit time within the permitted range for individual tariffs is at the sole discretion of the Provider

3. 2. The Provider does not allow to arrange a different length of one visit than the time range specified in point 3.1.

3. 3.  In the case of multiple orders for the same date of pet-sitting at the same customer and at the same place of pet-sitting, the visits can be combined into one block with the prior consent of the Provider. The times of the individual visits will be combined into one prolonged visit.

3. 4. The Provider reserves the right to charge for time spent at the place of pet-sitting beyond the maximum length of the visit at a price of CZK 500 per hour. The extra time is charged in 15 min blocks, where even a started block is charged as a whole block.
 

3. 5. The Customer is not eligible for compensation for a shortened visit if the time spent by the Nanny at the pet-sitting place is within the time range defined in point 3.1.

3. 5. 1. If the Nanny is in the place of pet-sitting for a shorter time than specified in point 3. 1., then the Customer is to be compensated in a fixed amount of CZK 100 for each such visit.

3. 6. The time spent by the Nanny at the pet-sitting location is recorded in the Roza electronic platform and marked as "Arrival" and "Departure". The time indicated in the electronic platform Roza is determinative and decisive. The Provider reserves the right to determine the time of arrival and departure differently from the Roza platform. 

3. 7. In case of an extraordinary situation there may be a visit:

3. 7. 1. Shortened by the Provider up to 10 min a visit at the Provider's decision.

3. 7. 2, The Provider reserves the right to shorten the visit, change the Nanny, change the time of the visit, cancel the visit even repeatedly without prior notice and consent of The customer.

3. 7. 3. For tariffs with more than one visit per day, the Provider has the right to limit the visit to only one per day. 

3. 7. 4. An extraordinary situation may be, but is not limited to, natural emergencies, strikes, and other restrictions or impacts on normal operations at the Provider, or externally, pandemics, closures, quarantines, etc. 

3. 7. 5. An extraordinary situation also includes situations caused by the sudden unavailability of the Nanny assigned to the pet-sitting order. 

3. 7. 6. The Customer shall not be entitled to any compensation or refund of the pro rata or full amount for a shortened or cancelled visit in an extraordinary situation.

3. 7. 7. The decision to declare an emergency is solely at the discretion of the Provider.

3. 7. 8. The Provider shall inform the affected Customers of the emergency as soon as possible. At the same time, the Customer agrees that priority is given to the provision and care of pets. 

4. Prices

4. 1. The price of the order is set according to the currently valid price list of the Provider in the Róza platform, prices are also listed on the website of the service "LazyFriday catio" of LazyFriday s.r.o. (www.catio.cz) in the section of price.
 

4. 2. The Provider reserves the right to change the prices at any time without prior notice.
 

4. 3.  The parties may also agree on a different, individual price. The provider reserves the exclusive right to determine the price.

5. Order, extension or shortening of the order

5. 1. The order for cat-sitting made by the Customer in any form is not legally binding for the Customer or the Provider, it is only of an informative nature and serves the Provider to schedule the time schedule of the Nannies for the provision of pet-sitting services in the sense of the services offered on the website of the "LazyFriday catio" service of LazyFriday s.r.o. (www.catio.cz).
 

5. 2. The order for cat-sitting becomes binding by signing the "Pet-sitting Agreement" and paying the order price to the Provider's bank account.

5. 3.  The Customer may extend or shorten the order at any time in agreement with the Provider. Payment for unused services shall be forfeited without refund to the Provider, unless the Provider agrees otherwise with the Customer

6. Payment for services provided

6. 1. The payment for the services provided is due before the Provider starts the service, which means after the initial meeting and signing of the "Pet-sitting Agreement".
 

6. 2. "Pet-sitting Agreement" serves as an invoice for the services provided..

6. 3.  The Customer shall be obliged to pay the amount to the Provider by bank transfer to the account: 2501524194/2010 at Fio Banka, a.s. with the variable symbol indicated on the "Pet-sitting Agreement". The variable symbol is the number of the "Pet-sitting Agreement".

6. 4.  The Customer shall be obliged to pay the amount to the Provider in full no later than 10 calendar days after the conclusion of the "Pet-sitting Agreement" or on the first day of the Pet-sitting Period (if the "Pet-sitting Agreement" was concluded less than 10 calendar days before the Pet-sitting Period).

6. 5.  The provider only accepts non-cash payments.

7. Cancellation policy

7. 1.  In case of cancellation of the order by the customer 24 hours before the date of the initial appointment, the pet-sitting order is cancelled without cancellation fee.
 

7. 2. In the event of cancellation by the Customer less than 24 hours before the date of the initial appointment, the pet-sitting order is charged a cancellation fee of CZK 200, unless the Provider agrees otherwise with the Customer.

7. 3.  . In the event of cancellation of the order by the Customer after signing the "Pet-sitting Agreement" and at the same time before the first agreed pet-sitting date, the Provider will charge the Customer a cancellation fee of 50% of the total price of the order. The Provider shall deduct the cancellation fee from the payment of the order by the Customer and return the remaining difference within 14 working days to the account from which the payment of the order was made

7. 4. In the event of cancellation of the order by the Customer after signing the "Pet-sitting Agreement" and at the same time during the provision of the service (pet sitting), the Provider will charge the Customer a cancellation fee of 100% of the total price of the order. 

7. 5. Exception from the payment obligation: in rare cases, the payment obligation to the Customer may be waived or reduced. Special cases include serious illness/injury/etc. The discretion of exemption from payment is entirely at the Provider's discretion.

8. Terms and conditions of the future order

8. 1. The Customer undertakes not to contact the Nanny directly for the next 24 months immediately after the termination of the cooperation or to respond to a direct offer of cooperation from the Nanny without contacting the Provider.

9. Privacy Policy

9. 1. The Customer agrees that the personal data provided will be processed and stored by the Provider and the Nanny in accordance with Act No. 101/2000 Coll., on the Protection of Personal Data, as amended, for the purpose of providing pet-sitting services.
 

9. 2. By ticking the box "The Customer agrees to the storage of personal data by the Provider in accordance with GDPR" in the"Pet-sitting Agreement". The Customer agrees, within the meaning of Act No. 101/2000 Coll., on the protection of personal data, as amended, that the Provider will process and use the User's personal data listed in the Agreement even after the end of the pet-sitting service.
 

9. 3.  The Customer has the right to be informed what data the Provider records about him/her and is entitled to change this data or to object to its processing in writing.

9. 4. The Provider reserves the right to provide the Customer's personal data to the extent necessary to third parties that perform services for the Provider (e.g. accounting, tax, legal advice).

9. 5. The Provider will use the Customer's personal data solely for the purpose of providing pet-sitting services, not for marketing or commercial purposes.

9. 6. The Provider is entitled to send the Customer its own commercial communications only if the Customer actively requests them, and only until the Customer informs the Provider that it wishes to stop sending them. The Customer may make this communication to the electronic address obtained in connection with the performance of the contract without incurring any costs.

9. 7.  Both the Provider and the Nanny must make every effort to protect the Customer's personal data and comply with the "Privacy Policy" located on the website of the "LazyFriday catio" service of LazyFriday s.r.o. (www.catio.cz).

10. General provisions

10. 1. Other matters not mentioned herein shall be governed by the Civil Code (No. 89/2012 Coll.), the Consumer Protection Act (No. 634/1992 Coll.) and other legislation, as amended.

10. 2.  Supervision of compliance with the obligations under Act No. 634/1992 Coll., on Consumer Protection, as amended, is carried out by the Czech Trade Inspection Authority (www.coi.cz).

10. 3.  "Pet-sitting Agreement", services and related issues are governed by Czech law.

10. 4. The wording of these General Terms and Conditions is binding on both parties.

10. 5.  These GTC shall come into force and effect on 15.03.2022. 

11. Governing law

11. 1. These Terms and Conditions, as well as the Contract, are governed by the law of the Czech Republic, in particular Act No. 89/2012 Coll., Civil Code, as amended.

11. 2. Any disputes arising under the Contract or these Terms and Conditions shall be decided by the courts of the Czech Republic having jurisdiction in the matter and place.

12. Effectiveness

12. 1. These Terms and Conditions shall come into force and effect on 15. 05. 2022.
